The Acceptable Use Policy below defines the actions which JSWD considers to be abusive, and thus, strictly prohibited. The examples named in this list are non-exclusive, and are provided solely for guidance to JSWD customers. If you are unsure whether any contemplated use or action is permitted, please contact us and we will assist you.

Customers are prohibited from transmitting on or through any of JSWD’s services, any material that is, in JSWD’s sole discretion, unlawful, obscene, threatening, abusive, libelous, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.

JSWD services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. JSWD reserves the right to remove such illegal material from its servers.

Harassment, whether through language, frequency, or size of messages, is prohibited.

Customers may not send email to any person who does not wish to receive it. If a recipient asks to stop receiving email, the customer must not send that person any further email.

Customers are explicitly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it.

Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings. Malicious email, including but not limited to "mailbombing" (flooding a user or site with very large or numerous pieces of email), is prohibited.

Forging of header information is not permitted.

JSWD accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider.

A web address (URL) or an e-mail address associated with JSWD may not appear in any message whether sent from a JSWD server or from another Internet Service Provider where this message violates this Acceptable Use Policy or the Acceptable Use Policy of that other provider.

You are also not permitted to distribute material promoting any form of network abuse (Such as bulk spam mailers, sniffers, or hacking tools).

A "clean-up" fee of up to $500 may be imposed for parties that engage in spaming or unsolicited e-mail activities that violate the above policies.

At JSWD and its officer’s discretion, access to JSWD’s hosting may be revoked at any time for abusive conduct on the system and/or the Internet and its resources as a whole. JSWD and its officer’s are deemed as authority to define abusive conduct to the system, and definitions may periodically change or be amended to previous ones.

Telnet and Shell Access is strictly prohibited.

You may use ftp to access your home directory for the purpose of installing and editing your web pages as often as necessary.

If any JSWD account is generating web traffic considered unusually high, we may require the site to be placed on a Heavy User server Virtual Server. We reserve the right to make this determination at our discretion.

Use of JSWD’s hosting constitutes acceptance of these Terms and Conditions. JSWD reserves the right to amend or modify the provisions hereof, in its sole discretion, without prior notification to you. Any such modifications or amendments will be posted on JSWD’s hosting policy web page. Your continued use of JSWD’s hosting after posting of said modifications or amendments shall constitute your acceptance thereof. If you do not agree to such modifications or amendments, your sole recourse is to terminate the your hosting services with JSWD.

JSWD reserves the right to suspend without prior notification, accounts which are deemed to be a threat to the functionality or existence of JSWD’s hosting.

JSWD shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, relating to the use, or the inability to use, the hosting system, or in any other way related to the hosting system, regardless of the form of action, whether in contract, tort (including negligence), or otherwise. additionally, JSWD and JSWD related parties shall not be liable whatsoever for any losses or damages that you may incur as a result of unauthorized use of the hosting system arising from "hacking" or otherwise, or for lack of fitness for a particular purpose of the hosting system. Finally, JSWD shall not be liable whatsoever for any damages that you may suffer because of service or hosting system failure, including domain name system failure, root server failure, internet protocol address failure, access delays or interruptions, data non-delivery or mis-delivery, acts of god, unauthorized use of passwords, errors, omissions or mis-statements in any information or other services provided under this agreement, delays or interruptions in development of web sites, or breach of security, even if JSWD has been advised of the potential for such damages, and even if JSWD may foresee such possible damages. Your sole remedy for indirect damages (in tort or otherwise) arising from or JSWD's breach of this agreement shall be a refund of the fees paid to jswd for the three (3) months immediately preceeding the date such claim arises or of such.

These Terms and Conditions supersede all previous representations understandings or agreements and shall prevail notwithstanding and variance with terms and conditions of any order submitted.
